1. Acceptance of Terms
By creating an account or using the Apiary platform ("the Service") at apiary.web.id, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
You must be at least 16 years of age to use the Service. By registering, you represent that you meet this requirement.
2. Description of Service
Apiary provides a digital platform for beekeepers to manage colonies, track honey production, schedule hive maintenance, and connect with buyers through a marketplace. The Service includes web-based tools for colony management, production tracking, inventory management, and product listing.
3. User Accounts
3.1 Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Account Security
You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Apiary will not be liable for any loss arising from unauthorized use of your account.
3.3 One Account Per Person
Each individual may maintain only one free account. Organizations and cooperatives may create one account per legal entity.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Upload or transmit viruses, malware, or malicious code
- Attempt to gain unauthorized access to other user accounts or the Service's systems
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to send unsolicited communications or spam
- Post false, misleading, or fraudulent product listings on the marketplace
- Scrape, extract, or harvest data from the Service without authorization
- Impersonate another person or entity
5. User Content
You retain ownership of the content you submit to the Service, including colony records, production data, and product listings. By submitting content, you grant Apiary a limited license to use, store, and display that content solely for the purpose of providing the Service to you.
You are solely responsible for the accuracy and legality of the content you submit. Apiary does not endorse or verify user-generated content.
6. Marketplace Transactions
Apiary provides a platform for buyers and sellers to connect. We are not a party to any transaction between users. We do not guarantee the quality, safety, or legality of products listed on the marketplace. Users engage in marketplace transactions at their own risk.
7. Intellectual Property
The Apiary name, logo, platform design, and original content are the intellectual property of Apiary. You may not use our trademarks or branding without prior written permission. The source code and platform architecture remain our exclusive property.
8. Payment and Billing
Paid plans are billed on a monthly or annual basis as selected during subscription. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods unless required by law.
We use third-party payment processors; we do not store your payment card details on our servers.
9. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or technical issues. We will make reasonable efforts to notify users of planned downtime.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Apiary shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
11. Termination
You may terminate your account at any time through your Account Settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if your account remains inactive for an extended period.
Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes as described in our Privacy Policy.
12. Changes to Terms
We may modify these Terms from time to time. We will notify registered users of material changes via email and update the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these Terms shall be resolved through good-faith negotiation before pursuing legal remedies.
